The binding contract is concluded when you receive the order confirmation from us.
Product availability
Please note that, exceptionally, we are under no obligation to deliver the order to you if our suppliers do not deliver the stock correctly or on time, even if we have acted in accordance with our usual ordering practice. In order for us to be able to apply such an exception and thus not assume any liability, we cannot be responsible for the unavailability of the products and we must have notified you of the situation without undue delay. In addition, we cannot have assumed a purchase risk in connection with the ordered product.
Therefore, all product orders are subject to availability and, in this regard, if there are difficulties in supply, or if there are no items in stock, we reserve the right to provide you with information about substitute products of equal or superior quality and value that you can order if you deem it appropriate. Consumer goods warranty
NAILS COUTURE shall deliver to the user products that are in conformity with the contract, i.e. conform to the description made and possess the qualities of the product that have been presented to the user and shall be liable to the user for any lack of conformity that exists from the time of delivery of the product.
In accordance with the provisions of Article 123 of Royal Legislative Decree 1/2007 of November 16, 2007, which approves the revised text of the General Law for the Defense of Consumers and Users, Isabella Maia de Alcántara shall be liable for any lack of conformity of the products that are manifested within two years of delivery.

In case of defective product, NAILS COUTURE will proceed, as appropriate, to repair, replacement, price reduction or termination of the contract, which will be free of charge for the consumer and user.
As a customer, you are considered a consumer in accordance with Royal Legislative Decree 1/2007, of November 16, 2007, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws (hereinafter, "TRLGDCU").
Consequently, you have the right to withdraw from the contract without having to justify your decision during the fourteen (14) calendar days from receipt of the purchased good or from the conclusion of the contract if it is a provision of services.
You must express your intention to cancel within the indicated period and proceed to return the product, and the price paid will be refunded.

Product pricing and payment

Terms and conditions of shipment
Nails Couture Beauty only ships to: Spain and the countries of the European Single Market.
The purchase is subject to the payment of shipping costs, at the buyer's expense. Shipping costs will depend on the destination, weight and total amount of the order, the costs will be detailed throughout the purchase process and you can check how much are the shipping costs before finalizing the purchase.
Isabella Maia de Alcántara will not be responsible for delays in the delivery of orders due to causes not attributable to it, as well as fortuitous cases or force majeure.
Delivery will be made by the transport company selected by the user during the purchase process.
Depending on their size, weight and destination, packages can currently be shipped through the following transportation agencies: Correos, Correos Express, Zeleris, GLS, Seur DPD and Nacex.
Delivery times
Delivery through Correos, Correos Express, Zeleris, GLS, Seur DPD or Nacex, will be made between 24 and 72 hours after payment confirmation, for products with availability and without customization, in Spain (peninsula). For the rest of the places or for products without availability, customized or under order, you can consult our page "Delivery Service" or request information through the contact form. Due to unforeseen circumstances there may be delays in delivery. If for any reason we are unable to meet the delivery date, we will inform you of this circumstance and give you the option to proceed with the purchase by setting a new delivery date or cancel the order with a full refund of the price paid. Please note that we do not deliver on Saturdays, Sundays or holidays. For the purposes of these conditions, it shall be understood that "delivery" has occurred or that the product/s have been "delivered" at the time of signing the receipt of the same at the agreed delivery address.
During sales season, special promotions, Black Friday and high product turnover dates such as Christmas, delivery dates may be delayed between 48 and 72 hours depending on product availability.
Delivery incidents
Please note any anomaly of the product on the delivery note at the time of delivery. If it has not been possible to record the fact on the delivery note, please contact us by e-mail the same day of delivery, or in any case, within 24 hours of delivery.
Please note the following transport regulations: The delivery note is proof of the condition of the goods. The consignee is obliged to state upon delivery if the shipment is damaged and if the shipment is complete. In case of replacement of a defective product: NAILS COUTURE undertakes to deliver another product in perfect condition and to pick up the defective one. In the event that this exchange cannot be made, you will be refunded the full amount of any advance payment.
From Monday to Friday from 11:00 am to 9:00 pm and on Saturday from 10:00 am to 3:00 pm, we will attend to all complaints and queries received about the delivery of your order at the e-mail address: info@nailscouturebeauty.com and through the messages left in the form provided in your order.
Telephone complaints will only be handled from Monday to Friday from 11:00 am to 3:00 pm.
Transfer of risk and ownership
The risks of the Products shall be borne by you from the time of delivery. You will acquire ownership of the Products when we receive full payment of all amounts due in connection therewith, including shipping costs, or at the time of delivery, whichever is later.
Methods of payment
The forms of payment accepted by nailscouturebeauty.com are:
- PAYPAL: You can pay on our website with your PayPal account or by credit or debit card using the secure PayPal gateway without having a PayPal account. To do so, you can use the "PayPal Checkout" or "Express Checkout" button from the product page, your shopping cart or during the checkout process. After confirming your order you will be taken to the PayPal website using their secure payment platform. Once the payment process is complete, you will be redirected back to tasteole.shop. Please note that all purchases processed through PayPal will incur a surcharge of 3,4% + 0,35€.

- CREDIT/DEBIT CARD: After confirming the order and selecting this payment method, you will be able to pay through BBVA's secure payment gateway without leaving the website.
- DIRECT BANK TRANSFER: You will be able to pay easily and securely with your usual online banking details, without credit card, wallet or virtual accounts using SOFORT's secure payment gateway technology and without the need to register with SOFORT. The transaction will be confirmed in real time and we will process your order immediately.
- ORDINARY BANK TRANSFER: The processing of your order will take longer if you select this payment method, since we need to confirm the payment. Please note that orders placed by bank transfer will be shipped as soon as we receive payment of the full purchase price, as well as any shipping costs. Credit card information
NAILS COUTURE at no time accesses or records the data relating to your credit card, as these are managed and entered directly through the virtual payment gateway of each payment method that we make available to you, which meet all the security conditions required by Spanish regulations.
Return / exchange policy
If you are not satisfied with your order you have a withdrawal period of 14 calendar days from the day you receive the products, as required by law. To return the products during this period we only ask you to notify us in writing using the following RETURN or WITHDRAWAL FORM, as appropriate, or by sending an email to the address: info@nailscouturebeauty.com indicating the data necessary to locate your purchase or using the means available for this purpose on our website. For our part, as soon as we receive your email, we will inform you, via email, the receipt of the same.
In order to comply with the deadline for returns, the communication regarding the return of the purchase must be sent before the expiration of the corresponding deadline.
In the event that the return is for reasons attributable to Isabella Maia de Alcántara (defective product or not matching the reference purchased) Isabella Maia de Alcántara who will be responsible for collecting the products and / or change them for the correct taking charge of the costs associated with this return and / or change.

IMPORTANT: In the case of a customized or custom-made product (ordered exclusively for you and under your responsibility), it cannot be returned, unless, of course, we have made a mistake in the preparation of your order or the product has a defect.
Consequences of withdrawal
In case of withdrawal on your part, we will reimburse the payments you have made, including shipping costs in the event that the return is for reasons attributable to NAILS COUTURE (defective product or not matching the reference purchased), with the exception of the additional costs resulting from your choice of a delivery method other than the least expensive ordinary delivery method offered by us, without undue delay and, in any case, within 14 days from the date on which we were informed of your decision to withdraw from this contract.
In the event that the return is for reasons not attributable to NAILS COUTURE as changes in color or other characteristics, which are due to a change of opinion or error on your part when making the purchase you must be the one who is responsible for returning or delivering the products directly to us in perfect condition without undue delay and, in any case, no later than within 14 calendar days after receipt of the products. In these cases NAILS COUTURE will refund all payments received, except shipping costs. Also, you will have to bear the direct cost of returning the products.
The refund will be made using the same payment method you used for the initial transaction, unless expressly agreed otherwise. We will not charge you any fees as a result of the refund. We may withhold the refund until we have received the products, or until you have provided proof of return of the products, whichever condition is met first.
The products must be returned or delivered at the latest within 14 days from the date on which you inform us of your decision to withdraw from the contract.
NAILS COUTURE will proceed to make the refund within 14 calendar days from the date on which we are informed of the decision to return the purchase and will do so using the same means of payment used by the customer for the initial transaction. Isabella Maia de Alcantara reserves the right to withhold the refund until the products have been received.
Exceptions to the right of withdrawal
Some products and services are excluded from the legally provided right of withdrawal, unless otherwise agreed.
According to Article 102 of the Revised Text of the General Law for the Defense of Consumers and Users, hereinafter TRLGDCU, the exceptions to the right of withdrawal are the following:
- Contracts for the supply of goods whose price is subject to fluctuations of market coefficients that the entrepreneur cannot control.
- Contracts for the supply of products made to the specifications of the consumer and user or clearly personalized, or which, by their nature, cannot be returned or are likely to deteriorate or expire rapidly.
- Contracts for the supply of sound or video recordings, discs and computer programs that have been unsealed by the consumer and user, as well as computer files, supplied electronically, capable of being downloaded or reproduced immediately for permanent use.
- Contracts for the supply of daily newspapers, periodicals and magazines.
- Contracts for the provision of services, the performance of which has begun, with the agreement of the consumer and user, before the end of the seven working day period.
- Contracts for betting and lottery services.
IMPORTANT: If the product is customized or made to order, it cannot be returned, unless, of course, we have made a mistake in the preparation of your order or the product has a defect.
In the event of contracting services, their execution will begin at the same moment of confirming the payment of the same, giving your express consent to do so when making the payment, thus waiving any right of withdrawal.
Any virtual product, offered under a download system and/or supplied electronically of any kind, as well as any software product, is excluded from the right of withdrawal.
Liability and disclaimer of liability
Our liability in connection with any product or service purchased on our website shall be strictly limited to the purchase price of such product. Nothing in these General Terms and Conditions of Sale excludes or limits our liability in any way.

- Impossibility of using trains, ships, airplanes, motor transport or other means of transportation, public or private.
- Inability to use public or private telecommunications systems.
- Acts, decrees, legislation, regulations or restrictions of other governments.
- Strike, failure or accidents of maritime or river transport, postal or any other type of transport.

- Fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic or any other natural disaster.
- Impossibility of using trains, ships, airplanes, motor transport or other means of transportation, public or private.
- Inability to use public or private telecommunications systems.
Our performance obligation under any Contract shall be deemed to be suspended for the period during which the Force Majeure Event continues, and we shall have an extension of time to perform our obligation for the duration of such period. We will use all reasonable efforts to bring the Force Majeure Event to an end or to find a solution whereby we can perform our obligations under the Contract despite the Force Majeure Event.
Disclaimer
If, during the term of a contract, we fail to insist upon strict performance of any of our obligations under the contract or these terms, or if we fail to exercise any of the rights or remedies that we are entitled to exercise or pursue under the contract or these terms, such failure shall not constitute a waiver of such rights or remedies or relieve you from compliance with such obligations. Any waiver by us to require performance shall not constitute a waiver by us to require subsequent performance. No waiver by us of any of these terms and conditions shall be effective unless expressly stated to be a waiver and communicated to you in writing in accordance with the notice section above.
Nullity and ineffectiveness of clauses
If any clause included in these Conditions is declared totally or partially null or ineffective, such nullity or ineffectiveness shall only affect such provision, and these General Conditions shall survive in all other respects, and such provision shall be deemed not to be included.
